Use of personal information. We collect and maintain your personal information in order to give you the best possible service and allow us to establish your identity, protect us from error and fraud, comply with the law and assess your eligibility in our products. We may also use your information for general research in an effort to enhance our service and product offerings.
Services delivered under these terms. By using Comicpresser.com™ (“Comicpresser”) services or by ordering a service, you acknowledge and agree that all services are provided subject to the Comicpresser Guarantee and the Comicpresser Terms and Conditions, as applicable.
You acknowledge and commit to pay for services ordered by our website or as you approve in writing by e.g., email. You authorize us to charge your payment method on file for any requested and authorized services and/or shipping.
If collectibles are submitted for tier categories and services for which they do not qualify or if values are under-declared, our Guarantee may not apply and you authorize Comicpresser to correct the order and charge any additional services, high value fees or shipping fees that may apply. You authorize Comicpresser to adjust any and all related fees & categories according to its sole determination of the current fair market value or proper category. Submissions will not be returned until all fees are paid.
You understand and agree that once your submission is delivered to Comicpresser, it cannot be cancelled or changed, and no refunds will be issued. Incomplete forms and improperly packaged collectibles will not be accepted.
Responsibilities & options. You acknowledge that you are responsible for safely and securely packaging your collectibles in boxes, and that you have determined how to package the collectibles to prevent damage during the normal shipping & handling process. You assume all risk of loss or damage that occurs during shipment to Comicpresser or that occurs due to your improper packaging. You understand that Comicpresser will not confirm the quantity, type or condition of collectibles until your submission is opened and imaged.
You may submit collectibles in holders (“slabs”). Collectibles in holders are designed to be tamper-evident and extremely difficult to open. Even when carefully handled, damage might still occur to a collectible removed from a holder, resulting in a lower grade than before. You assume all risk when having us open any holder.
Risks when submitting. Some collectibles with glossy printed surfaces might experience “color lift” when removed from a holder or container, possibly resulting in a lower grade than before. Some signatures written with a “paint pen” might lift off when removed from a holder, resulting in the loss of the signature.
Pressing, dry cleaning, deep cleaning, conservation, restoration and restoration removal services could potentially cause damage or introduce new defects to your collectible including, but not limited to, spine splits, popped staples, paper pieces chipping off, paper tears, creases, color loss and stains, which might result in a lower grade than anticipated. You assume all risk when having us clean, press, repair and conserve your collectibles.
Comicpresser does not provide grading services. Comicpresser can not and will not Guarantee any grades or grade increases. Comicpresser can not and will not Guarantee that your cleaned and/or pressed collectible will be returned from any grading company after one or more attempts as Universal (blue label) vs. other grading classes e.g., Conserved (blue/gray label), Qualified (Green label) or Restored (purple label).
Our rights. Comicpresser retains all rights to its Intellectual Property in any transaction or engagement with you, involving you or disclosed to you. Intellectual Property includes but is not limited to: trademarks, copyrights, patents, designs, inventions, code, data, images, photographs, methods, systems, procedures, processes, workflows, customer lists, supplier lists, user interfaces and other intangible assets created in the background or foreground of work we do related to your collectibles and accounts.
Insurance. Comicpresser maintains insurance for: any in-transit damage to items that we ship; burglary; fire; flood; or damage during storage only. Neither insurance nor Comicpresser covers damages that may occur while performing work on collectibles, including but not limited to: fading, creasing, denting, scratching, tearing, thinning, transfer of colors, wear and tear, or deterioration; dampness or dryness of atmosphere; corrosion, rust or mold; changes in or extremes of temperature other than fire; nesting or infestation, or discharge or release of waste products, by insects, birds, rodents or other animals; work done on your collectibles by Comicpresser or others working on our behalf; delay, loss of use, loss of market value or loss of market opportunity.
Your responsibilities. It is your sole responsibility to thoroughly inspect your collectibles for restoration, missing pages, rust, cutouts, writing, loose staples, detachments or inserts and other defects. While we will review your items in preparation for specifically providing our services, identifying the aforementioned defects are outside the scope of our offerings.
You accept and acknowledge that all of the above-described risks & conditions are associated with your submission and agree to release, waive and discharge Keys N Runs LLC D/B/A Comicpresser.com (a Georgia corporation; with these terms to be applied under Georgia law) and its employees, directors, agents, representatives and assigns from all liability for actual & associated damage to any submitted collectibles in our care or under our services, whether caused by our negligence or not.
Workshop Terms and Conditions
Comicpresser may now or in the future offer expert, consultative and advisory services in the form of Workshops. All Workshops are to be paid for in full in advance to reserve your place. We do not offer refunds. Workshops take prior planning and preparation. All cancellations forfeit their booking fee.
Workshop bookings are eligible for date changes or exchanges up to 14 days in advance of workshop date. You must inform us in writing for any changes you wish to make. While we will endeavor to accommodate all requests, we cannot guarantee a suitable workshop at a date which suits all parties will be available.
If we are required to cancel a workshop for any reason, full refund or alternative dates will be offered. If this happens we will work with you to arrange a suitable new date for you to attend. If you choose to attend a new workshop, the full terms will apply to the new booking and a refund will not be offered after the initial cancellation by us.
By purchasing and participating in the Workshop, you warrant that you have read and reviewed this Agreement and that you agree to be bound by it. Comicpresser only agrees to provide the Workshop to you if you assent to this Agreement.
We may provide you with certain information as a result of your accessing of the Workshop. Such information may include, but is not limited to, documentation, data, or information developed by us and other materials which may assist in your participation in the Workshop (“Materials”). Subject to this Agreement, we grant you a non-exclusive, limited, non-transferable and revocable license to use the Materials solely in connection with your participation in the Workshop and your use of the Website. The Materials may not be used for any other purpose, and this license terminates upon your completion of the Workshop, your cessation of use of the Workshop or the Website, or at the termination of this Agreement.
The Workshop and any of its accompanying Materials are for the registered individual only and may not be shared with any party. If we suspect that the Workshop or Materials are being shared and/or that you have shared your information with any party, we reserve the right to immediately terminate your access to the Workshop and Materials, in our sole and exclusive discretion. We may also bill fees for additional registration(s) if it is determined that others viewed, participated in, or otherwise had access to the Workshop or Materials.
We do not offer any promises or guarantees with regard to our Workshop or Workshop Materials. You hereby acknowledge and agree you are solely and exclusively responsible for the choices that you make with regard to any Workshop, the Materials contained within it, or any significant changes to your business or collectibles. You also agree that we are not liable for any result or non-result or any consequences which may come about due to your participation in the Workshop.
You agree that the Materials, the Workshop and any other Services provided by Comicpresser are the property of Comicpresser, including all copyrights, trademarks, trade secrets, patents, and other intellectual property (“Company IP”). You agree that the Company owns all right, title and interest in and to the Company IP and that you will not use the Company IP for any unlawful or infringing purpose. You agree not to reproduce or distribute the Company IP in any way.
Copyright in all photographs, video, and related materials created by the participant (“Workshop Materials”) will belong to the participant upon creation. The participant grants to Comicpresser a non-exclusive, worldwide, irrevocable license to use any Workshop Materials provided to Comicpresser in any media for the following limited purposes: editorial use, promotion of this editorial use or promotion of Workshop programs.
Through your participation in the Workshop, you may be permitted to post materials to the Workshop pages (“User Contributions”). You hereby grant Workshop Provider a royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit and make derivative works of User Contributions you post. The Workshop Provider claims no further proprietary rights in your User Contributions.
You also agree to comply with the “Acceptable Use” provision of this Agreement for all User Contributions that you post, including and especially to not violate the intellectual property rights of any third party through your User Contributions.
The Workshop is provided for informational purposes only. You acknowledge and agree that any information posted in the Workshop, or in the Materials is not intended to be technical advice, legal advice, medical advice, or financial advice, and no fiduciary relationship has been created between you and us. You further agree that your participation in the Workshop is at your own risk. We do not assume responsibility or liability for any advice or other information given in the Workshop or in the Materials.
You agree that your participation in the Workshop and your use of the Website is at your sole and exclusive risk and that any Services provided by us are on an “As Is” basis. We hereby expressly disclaim any and all express or implied warranties of any kind, including, but not limited to the implied warranty of fitness for a particular purpose and the implied warranty of merchantability. We make no warranties that the Workshop will meet your needs or that the Workshop will be uninterrupted, error-free, or secure. We also make no warranties as to the reliability or accuracy of any information in the Workshop. You agree that any damage that may occur to you, through your applied learnings, or as a result of loss of your collectible from your participation in the Workshop is your sole responsibility and that we are not liable for any such damage or loss.
We reserve the right to take photographs or videos during the operation of any Workshop or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By signing up for a Workshop, the participant agrees to allow his/her likeness to be used by Us and our authorized third parties without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to beginning of the Workshop.
